Article 1: Scope of application

These general terms and conditions of sale apply to all transactions concluded via the websites of the KARATE-GI network.

A “customer” is any individual or legal entity placing an order with KARATE-GI via a secure payment platform (Paypal or other), or by cheque, bank transfer, cash or any other means.

The only version of this document which implies a contractual agreement is the current version available on the https://karate-gi.fr/cgv/ website.

Article 2: Ordering

Any order placed on a site belonging to KARATE-GI implies full and unreserved acceptance of these terms and conditions of sale.

Article 3: Prices

Prices are given in euros and include all taxes, but exclude shipping and handling costs. Prices may be changed at any time. However, the price applied to an order will be the one announced at the time of the order.

Article 4: Payment

Payment is due immediately on the order date, including for pre-ordered products. Payment can be made by credit card, Paypal, cheque, bank transfer or cash (secure entry using SSL encryption).

Article 4.1 : Payment by BANK CARD

We accept credit card payments via the secure payment platform of one of our financial partners (Payplug or Stripe). All the information you enter is secured by SSL encryption and then processed by the financial partner’s payment terminal. The partner’s platform detects whether strong authentication is required. If so, the financial partner uses 3D Secure 2 to authenticate the customer using a unique code or biometric ID, depending on the bank’s requirements.

Article 4.2 : Payment by PAYPAL

We accept payment via your Paypal account.

You can also pay by credit card via Paypal, which accepts the most common credit cards including : CB, Visa, Mastercard, American Express, Aurore, Cofinoga, 5 stars registered via the Paypal platform
If your credit card payment is refused, there may be several reasons, including:
As Paypal has stepped up its verification process to combat fraud, the company cannot verify that you are the cardholder, and the only solution is to create a PAYPAL account. It’s not very complicated: you just need to register your details and those of your credit card once, via their secure platform. This will also enable you to buy easily and securely on many sites that work with this payment method, without having to communicate your credentials again, simply with your login and password.
To pay for subscriptions via Paypal, creating a Paypal account is mandatory.
PayPal users can provide payment via the funds in their PayPal account or by credit card approved by PayPal. Orders paid via PayPal funds or Credit Card will be immediately available for delivery. Refunds for transactions paid via PayPal are refunded to your PayPal account only. We are a PayPal verified seller.

Paypal accepts : CB, Visa, Mastercard, American express, Carte Aurore, Cofinoga, Cofidis.

Article 4.3: Payment by cheque

We accept payment by cheque regardless of the amount of your order.

If you wish to pay by cheque, simply select the cheque payment option on the order page and confirm. Then send us your payment, clearly indicating your full name, address and order reference.

Payment by cheque is only possible for cheques in euros drawn on a bank domiciled in France.

The cheque will be cashed before the order is dispatched, unless otherwise agreed by KARATE-GI.

Article 4.4: Payment by bank transfer

We accept payment by bank transfer regardless of the amount of your order.

If you wish to pay by bank transfer, simply select the bank transfer option on the order page and confirm.

Our bank details (RIB) will be sent to you by e-mail with your invoice.
Make your transfer directly from your bank account, specifying your order reference.

Your order will be processed and dispatched upon receipt of your transfer by our bank.

Article 4.5: Payment in instalments

Occasionally, we can accept payment in installments, under certain conditions, with one of our following financial partners: ALMA, FLOA BANK (via Lenbox)

4.5.1 Payment in instalments with Alma

Karate-Gi may offer you Alma’s credit service for the settlement of your purchases and the execution of payment. This is subject to acceptance by the Customer (you) of the GCU or of the credit agreement proposed by Alma.

Any refusal by Alma to grant credit for an order may result in its cancellation, unless the customer agrees to pay cash.

Any termination of the General Terms and Conditions between the Customer and the Seller shall result in the termination of the General Terms and Conditions or the credit agreement between Alma and the Customer.

Payment in instalments is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amount
  • P2X: Only purchases between €50 and €2,000 are eligible for 2x payment with Alma.
  • P3X: Only purchases between €50 and €2,000 are eligible for 3x payment with Alma.
  • P4X: Only purchases between €50 and €2,000 are eligible for 4x payment with Alma.
Fees

When paying in instalments with Alma, the customer pays additional charges which are displayed at the time of your order.

Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.

Payments in 5 or more instalments (e.g. 10 instalments).

Karate-Gi can sometimes offer you payment in 5 instalments or more via our partner Alma. In accordance withArticle L312-45 of the French Consumer Code, we hereby inform you that :

  • The amount is paid by a credit granted by the company Alma, registered on the REGAFI under number 90876, SAS with a capital of 316,226.83€, RCS Nanterre 839 100 757, Approved ACPR under N°90789 – Contact: support@getalma.eu.
  • Karate-Gi is a credit indicator in accordance with R.519-2, 1° of the French Monetary and Financial Code. The company Karate-Gi distributes advertisements sent by Alma concerning the granting of credit by Alma.
  • Payment: Payment by credit is available for the settlement of your purchases via our partner Alma, the execution of the payment is conditioned by the signature of the credit contract proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the Customer in accordance with Article L312-46 of the French Consumer Code. If Alma agrees to grant credit to the Customer, the amount will be paid by credit in accordance with article L312-45 of the French Consumer Code. Any refusal by Alma to grant credit for an order may result in its cancellation, unless the customer agrees to pay cash. Any termination of the General Terms and Conditions binding the Vendor and the customer will result in the termination of the credit contract between Alma and the customer. In the event of withdrawal, the costs and interest incurred by the customer will be reimbursed in accordance with regulations.
  • Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.

4.5.2 Payment in instalments with LENBOX by FLOA BANK

Karate-Gi can offer you the FLOA BANK credit service via LENBOX (ex FINNOCAR ) for the settlement of your purchases and the execution of payment. This is subject to acceptance by the Customer (you) of the GTC proposed by LENBOX and the proposed credit agreement.

In accordance withArticle L312-45 of the French Consumer Code, we hereby inform you that :

  • Karate-Gi is a credit indicator in accordance with R.519-2, 1° of the French Monetary and Financial Code. The company Karate-Gi distributes the advertisements sent by LENBOX concerning the granting of credit by FLOA BANK.
  • Payment: Payment by credit is available for the payment of your purchases via our partner LENBOX, the execution of the payment is conditioned by the signature of the credit contract proposed by FLOA BANK. The Seller accepts in advance the credit agreement concluded between FLOA BANK and the Customer in accordance with Article L312-46 of the French Consumer Code. If LENBOX agrees to grant credit to the Customer, the amount will be paid by credit in accordance with Article L312-45 of the French Consumer Code. Any refusal by LENBOX to grant credit for an order may result in the cancellation of the order, unless the customer agrees to pay cash. Any termination of the General Terms and Conditions binding the Vendor and the customer will result in the termination of the credit agreement between LENBOX and the customer. In the event of withdrawal, the costs and interest incurred by the customer will be reimbursed in accordance with regulations.
  • Security: Payment security is ensured by LENBOX and its service providers. All payments are protected by 3D Secure. LENBOX is a tele-payment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
Fees

When paying in instalments with LENBOX, the customer pays additional charges which are displayed when the order is placed.

Article 5: Delivery

Delivery is made to the address you gave when you placed your order (so please pay particular attention to the spelling of the address you enter, and especially to the zip code) or to a parcel relay of your choice (or one close to your home).

In the event of a lost parcel, we will ensure that you still receive your product or that you are reimbursed according to your warranty.

Customs duties and local taxes :

If your order concerns a country outside the European Union or French overseas departments and territories, customs duties and taxes may be added depending on your country. We are not responsible for these charges, which are based on local regulations in your country. They are always at your expense and must be paid to the carrier on receipt of your order. If you do not pay these charges when you receive your order, your packages will be returned to us automatically by the delivery company. We will not be able to reimburse a customer who has refused to pay these customs duties and taxes.

If your order is for France (excluding French overseas departments and territories) or any other European Union country, don’t worry, you won’t be charged any customs fees or additional taxes. However, it may happen that, in order to reduce delivery times, we have your order delivered directly from Japan (for Hirota or Tokyodo, for example), and that customs may charge you fees and taxes. In this case, don’t worry: we’ll either pay these charges directly, or, if you have to pay them yourself, we’ll reimburse you.

Article 6: Pre-ordering

For “Pre-order” products, i.e. those you can purchase before their official release, payment is due immediately upon ordering.

Provisional product release dates are not contractual.
We do our best to respect the provisional dates we indicate, however actual dates often depend on factors beyond our control (e.g. printing delays, DVD pressing, natural disasters).

If you’re impatient by nature and intend to email us every day to find out if the product you pre-ordered has been released, we’ll refund you immediately to give you some peace of mind. If you want to be absolutely sure that your product will be shipped on a specific date, DO NOT PRE-ORDER. Just wait until the product is officially released, and save everyone unnecessary stress.

Article 7: Return and refund conditions

In accordance with current legislation, you have the right to cancel your order within 14 days without giving any reason. The cancellation period expires 14 days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last product in your order.

However, to ensure that our customers have nothing to worry about, we have decided that all our products and services come with a 60-day satisfaction guarantee.

(We want to be absolutely certain that all our customers are delighted to have worked with us and are satisfied).

Article 7.2 Refund conditions by product type

Physical products

Unless otherwise stated on the product description page, all our physical products come with a 60-day satisfaction guarantee. If you are not satisfied within 60 days from the date of delivery of your order, return the product for a full refund (including shipping costs for France Métropolitaine).
Please note: Personalized items cannot be refunded or exchanged (unless we are at fault). Kimonos, protections and other items must not have been worn during training, washed or stained for us to be able to issue a full refund or exchange.

Electronic products

Unless otherwise stated on the product description page, all our electronic products come with a 60-day satisfaction guarantee. If you are not satisfied within sixty days of delivery of your order, simply contact us by e-mail or post as indicated above and request your refund.

Subscriptions :

Unless otherwise stated on the subscription page, all our subscriptions come with a 60-day satisfaction guarantee. If you are not satisfied within sixty days of your subscription, simply contact us by e-mail or post as indicated above to request your refund.

Subscriptions are renewable by tacit agreement and will therefore be tacitly renewed between the parties for the same term in the absence of termination by one of them, in accordance with the paragraph below:

Cancellation and refund of subscriptions

Subscriptions renewable by tacit agreement may be cancelled at any time. Termination will take effect on the subscription expiry date following the date of termination.

To cancel your subscription, simply contact us by e-mail or post as indicated above to request the cancellation of your subscription.

If your cancellation request is received by us within 30 days of the expiry date of your subscription, and we have not had time to cancel your subscription before it is automatically renewed, we will automatically refund this renewal within 30 days of your cancellation request and proceed with the effective cancellation of your subscription.

example: You sign up for a 1-year subscription on 24/02/2022 and ask to cancel your subscription on 20/02/2023. We’ll do our best to accommodate you, but as the deadline is very short, if your subscription is automatically renewed on 24/02/2022 and your account is debited, we’ll automatically refund you before 20/03/2023.

The 60-day satisfaction guarantee is also renewed by tacit agreement, i.e. during the 60 days following the expiry of your subscription, you can request a refund by simply contacting us by e-mail or post as indicated above.

Repayment terms according to payment method

Whatever your method of payment, we will refund you directly to your original payment method in accordance with the requirements of our financial partners:

  • Credit card: the amount is automatically credited to your bank account.

  • PayPal: the refund is made to your PayPal account.

  • Cheque or bank transfer: reimbursement is made by bank transfer (we will simply ask you for your bank details if necessary).

  • Payment in instalments via a financial partner (e.g. ALMA, FLOA, etc.): We reimburse our financial partner directly, who then adjusts your remaining direct debits or reimburses you for amounts already paid.
    You don’t have to do a thing: everything is handled automatically for you.

Article 7.3 Product returns

In the event of receipt of defective or non-compliant products, we undertake to replace or refund the amount of the product(s) ordered.

There are a few rules that must be observed:

  1. Contact us by e-mail (contact@karate-gi.fr) so that we can give you the return information beforehand.
  2. Return defective or non-compliant products to us with the corresponding order number.

We will send you a return postage voucher if you return your order for any reason attributable to us: delivery error, defective item.

Article 8: Availability and presentation

Orders will be processed within the limits of our available stocks or subject to our suppliers’ available stocks.

If an item is unavailable for more than ten working days, you will be informed immediately of the expected delivery times, and the order for this item may be cancelled on request. The customer may then request a credit note for the amount of the article or a refund.

The photos of our electronic products are “presentation suggestions”, i.e. the images do not always correspond exactly to the product you will receive in the end, especially for pre-orders, where the visuals are not always definitive.

Article 9: Protection of personal data

KARATE-GI respects your privacy. Our Privacy Policy sets forth our privacy practices regarding the collection and management of your information through our website, products, online services, applications and other tools we offer online and offline. Article 10: Settlement of disputes

In the event of any dispute, difference or claim arising out of or in connection with these terms and conditions (and in particular any dispute concerning the validity, interpretation, breach or termination of these terms and conditions) (hereinafter the “Dispute”), the parties shall attempt to reach an amicable settlement of their Dispute before submitting such Dispute to the courts.

Within our newsletters, communications, and websites, we may recommend tools, websites, products, or service providers that can provide you with a useful complement to our services.
When this is the case, we generally partner with the companies that market these products or services – we therefore receive a commission if you decide to purchase these products or services on our recommendation.
